Background
1On the pre-hearing conference (“PHC”) telephone conference call (“TCC”), the parties requested that the PHC be adjourned for a period of four months to allow for public consultation and settlement discussions.
2The parties did not oppose the requests for participant status by Norman Track, Melissa Duff and Susan Duff.
3The parties did initially oppose the request for party status by the Harbord Village Residents Association (“Residents’ Association”) submitting that the request was premature and that until the issues are clarified the Residents’ Association should have participant status, without prejudice to a future request for party status. Upon hearing the submissions of Ms. Dexter as the representative of the Residents’ Association, the City of Toronto withdrew its objection to the granting of party status. The Conservation Review Board (“Review Board”) finds that:
a. the Residents’ Association has demonstrated that it has a genuine interest in the issues arising from this matter; and,
b. the Association will make a useful and different contribution to the understanding of the matter, even at an early stage in the proceeding.
Order
4The Review Board orders that:
Pursuant to Rule 21 of the Rules of Practice and Procedure of the Review Board, the Harbord Village Residents’ Association, as represented by Susan Dexter, is added as a party to the proceeding.
Pursuant to Rule 22 of the Rules of Practice and Procedure of the Review Board, the following persons are added as participants to the proceeding:
a. Norman Track
b. Melissa Duff
c. Susan Duff
- The PHC is to continue by TCC on August 30, 2017 at 10:30 a.m., if required. The parties and participants are to confer amongst themselves and advise the Review Board Case-Coordinator, Ms. Shannon Carrick, on or before August 23, 2017 of dates in the weeks of November 20 and 27, 2017 (approximately four months from the date of the initial PHC by TCC), that they are all available to continue the PHC by TCC. If the parties and participants are able to agree upon a date that is also suitable to the Review Board, to be confirmed by the Review Board in writing, then the PHC by TCC scheduled for August 30, 2017 may not be necessary and the parties and participants will be so advised. If the parties and participants are unable to agree on a date to continue the PHC in approximately four months time, then the PHC by TCC scheduled for August 30, 2017 at 10:30 a.m. will proceed.
