DECISION AND REASONS
This matter came on for hearing before a panel of the Discipline Committee (the “Panel”) of the College of Nurses of Ontario (the “College”) on April 26, 2023, via videoconference.
Publication Ban
College Counsel brought a motion pursuant to s.45(3) of the Health Professions Procedural Code of the Nursing Act, 1991, for an order preventing public disclosure and banning the publication or broadcasting of the name(s) of the patient(s), or any information that could disclose the identity(ies) of the patient(s), referred to orally or in any documents presented at the Discipline hearing of Natasha Petit.
The Panel considered the submissions of the College Counsel and Member and decided that there be an order preventing public disclosure and banning the publication or broadcasting of the name(s) of the patient(s), or any information that could disclose the identity(ies) of the patient(s), referred to orally or in any documents presented at the Discipline hearing of Natasha Petit.
The Allegations
The allegations against Natasha Petit (the “Member”) as stated in the Notice of Hearing dated November 1, 2022 are as follows:
IT IS ALLEGED THAT:
- You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(1) of Ontario Regulation 799/93, in that while employed as a Registered Practical Nurse at Caressant Care Nursing and Retirement Home in Cobden, Ontario, you contravened a standard of practice of the profession or failed to meet the standard of practice of the profession, and in particular:
(a) on one or more occasions between about 2020 and January 29, 2021, you engaged in a pattern of behaviour towards colleagues, and/or behaved towards colleagues in a manner, that was abusive, belittling, and/or inappropriate, including with respect to the following incidents:
(i) you said words to the effect of “all staff are lazy” while in the dining room in the presence of staff and patients;
(ii) you said to [Colleague A] “I told you I didn’t want to see you”;
(iii) you called colleagues vulgar names including “twat” and/or “fuckhead”;
(iv) you said to [Colleague B] words to the effect of “I will meet you out in the parking lot”;
(v) you kicked [Colleague C] while in the dining room in the presence of staff and patients; and/or
(vi) you slapped [Colleague D] on the arm;
(b) on or about January 21, 2021, you said to [Patient A] words to the effect that you would not give him his pain medication if he did not finish his supper;
(c) on multiple occasions between about April 2020 and January 29, 2021, you failed to wear a face mask while working, despite being required to do so by public health measures and/or workplace policies;
- You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(7) of Ontario Regulation 799/93, in that while employed as a Registered Practical Nurse at Caressant Care Nursing and Retirement Home in Cobden, Ontario, you abused a patient verbally, physically, or emotionally, and in particular:
(a) on or about January 21,
