DECISION AND REASONS ON REQUEST TO ADJOURN SINE DIE
This matter came on for hearing before a panel of the Discipline Committee (the "Panel") of the College of Nurses of Ontario (the "College") on March 22, 2021, via videoconference. Jody MacDonald (the "Member") was not in attendance.
The Panel was asked to consider allegations against the Member contained in three separate Notices of Hearing all dated February 23, 2021. This Decision and Reasons addresses the allegations set forth in the first of these three Notices of Hearing dated February 23, 2021. College Counsel requested that the hearing of the allegations in the first Notice of Hearing be adjourned sine die.
College Counsel's Submissions
College Counsel submitted that as the allegations in the second Notice of Hearing dated February 23, 2021 have a statutory requirement for revocation the public interest is protected further to the hearing of the allegations in the second Notice of Hearing. As a consequence, given the impact on time and resources and the witnesses required to address the initial allegations in the first Notice of Hearing dated February 23, 2021, it is not in the public interest to pursue a hearing on them at this time.
Decision
Having considered the submissions of College Counsel, the Panel agreed to adjourn the allegations in the first Notice of Hearing dated February 23, 2021, sine die.
Reasons for Decision
The Panel's pending determination of the allegations against the Member in the second and third Notices of Hearing dated February 23, 2021, as well as the resources required to bring forth witnesses to address the allegations in the first Notice of Hearing, satisfied the Panel that it was appropriate and in the public interest to adjourn the allegations in the first Notice of Hearing dated February 23, 2021, sine die.
