DECISION AND REASONS
This matter came on for hearing before a panel of the Discipline Committee on March 19, 2007 at the College of Nurses of Ontario (the “College”) at Toronto.
The Allegations
The panel received the Notice of Hearing. College Counsel then brought a motion for an order authorizing the College to withdraw allegations #1(d)(g)(h)(j), #2(a)(b)(c)(d)(e), and #3(c)(d)(h)(i)(k) set out in the Notice of Hearing. Counsel for the College informed the panel that the College would not be submitting any evidence on these allegations. The panel considered the submissions of Counsel and authorized the withdrawal of the allegations. The remaining allegations against the Member as stated in the Notice of Hearing dated February 6, 2007 [ ], are as follows:
- You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(1) of Ontario Regulation 799/93, in that while working as a Registered Nurse at [Facility A], in [ ] Ontario, you contravened a standard of practice of the profession or failed to meet the standards of practice of the profession, with respect to the following incidents:
(a) Your inappropriate and uncaring attitude exhibited toward the husband of [Client A], in the presence of the client, on or about October 25, 2000; and/or
(b) Your inappropriate and uncaring attitude exhibited toward [Client B] and the mother of [Client B], in the presence of the client, on or about April 27, 2001; and/or
(c) On or about June 7, 2001, you left your shift without giving a report to the charge nurse; and/or
(d) [Withdrawn]
(e) Your inappropriate and uncaring attitude exhibited toward [Client C] and the daughter of [Client C], in the presence of the client, on or about July 12, 2001 and/or August 12, 2001; and/or
(f) Your conduct in pulling [Client C]’s arm roughly, on or about July 12, 2001; and/or
(g) [Withdrawn]
(h) [Withdrawn]
(i) Your inappropriate and uncaring attitude exhibited toward the mother and family of [Client D], on or about December 5, 2001; and/or
(j) [Withdrawn]
(k) Your inappropriate and uncaring attitude exhibited toward the wife of [Client E], on or about May 5 or 6, 2002; and/or
(l) Your inappropriate and uncaring attitude exhibited toward the mother of [Client F], on or about May 7, 2002; and/or
(m) Your inappropriate and uncaring attitude exhibited toward the wife of [Client G], in the presence of the client, on or about May 13, 2002.

You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(37) of Ontario Regulation 799/93, in that, while working as a Registered Nurse at [Facility A], you engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, with respect to the following incidents:
(a) Your inappropriate and uncaring attitude exhibited toward the husband of [Client A], in the presence of the client, on or about October 25, 2000; and/or
(b) Your inappropriate and uncaring attitude exhibited toward [Client B] and the mother of [Client B], in the presence of the client, on or about April 27, 2001; and/or
(c) [Withdrawn]

(e) Your rude and inappropriate communication towards [two colleagues], in the presence of a client, on or about September 6, 2001; and/or
(f) Your inappropriate and uncaring attitude exhibited toward [Client C] and the daughter of [Client C], in the presence of the client, on or about July 12, 2001 and/or August 12, 2001; and/or
(g
