REINSTATEMENT

A Panel of the Discipline Committee held a reinstatement hearing in respect of Unice Hardie, the applicant, on August 31, 2000.
The applicant had her Certificate of Registration revoked pursuant to an order the a Panel of the Discipline Committee made as of January 8, 1998 having been found to have committed professional misconduct.
The onus to satisfy the panel that reinstatement take place was on the applicant. The panel heard evidence and submissions from the applicant and the College. Having carefully considered the matter, the panel was of the view that the applicant’s Certificate of Registration should be reinstated subject to certain terms, limitations and conditions and the appropriate direction was provided to the Executive Director to do so.
The terms, conditions and limitations imposed on the applicants Certificate of Registration are as follows:
The panel unanimously decided to:
Direct the Executive Director to issue a new Certificate of Registration to Unice Andrea Hardie;
Direct the Executive Director to impose the following terms, conditions and limitations on the Member’s Certificate of Registration:
a. The Member may not work in the home of clients, or in any other form of independent practice.
b. The Member may only work in a facility where at least one other member of the College is present at all times to monitor her practice.
c. The Member must request of any facility for whom she is, or becomes employed as a nurse, and the Director of the Investigations and Hearings Department of the College must receive, within 15 days of the effective date of this order, in the case of the Member’s current employment, or within 15 days of the date of the Member beginning any new employment, a letter from the employer indicating:
i. the date on which the Member began her employment with the employer,
ii. that the Member has provided the employer with a copy of the 1997 decision of the Discipline Committee of the College of Nurses revoking her Certificate of Registration,
iii. that the employer is aware that the Member may not work in the homes of clients, or in any other form of independent practice, but may only work when at least one other member of the College is present at all times to monitor her practice.
iv. that the employer agrees to immediately notify the Executive Director of the College in the event the employer learns of any reasonable information that may implicate the Member in the misappropriation of property from a client or the workplace, and that the employer will cooperate fully with the College’s investigation into the Member’s potential professional misconduct.
d. With respect to retraining, the Member must do the following:
i. Before returning to work as a nurse, the Member must complete the College’s Self Assessment Tool with particular attention to ethics and clinical skills, and must, in consultation with a College Practice Consultant, develop a learning plan to address her learning needs, with particular emphasis on ethics and clinical skills, and
ii. Within one year of returning to work as a nurse, the Member must fully implement the learning plan referred to above, and
iii. At six months and one year after returning to work as a nurse, the Member must update the Practice Consultant in writing on her progress in implementing the learning plan, providing copies of her update to the Director of the Investigations and Hearings Department, and
iv. The Member’s updates to the Practice Consultant and the Director referred to above must include a copy of a Peer Feedback Worksheet from the Self Assessment Tool, completed by a member of the College with whom the Member has been working for at least the prior 3 months.
- Directs that any application to remove or alter the above terms, limitations or conditions may be made to a panel of the Discipline Committee of the College of Nurses of Ontario.
