This matter came on for hearing before a panel of the Discipline Committee on November 30, 2000 at the College of Nurses of Ontario at Toronto.
The Allegations
The allegations against Kathryn Visser as stated in the Notice of Hearing dated November 14, 2000, are as follows:
You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(1) of Ontario Regulation 799/93, in that on or about April 27, 1999, while employed as a Registered Practical Nurse at [the Hospital], you contravened a standard of practice of the profession or failed to meet the standards of practice of the profession with respect to your care and treatment of [client “A”], and in particular, you made inappropriate comments and/or spoke in an inappropriate tone of voice to the client.
You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and
defined in subsection 1(37) of Ontario Regulation 799/93, in that on or about April 27, 1999, while employed as a Registered Practical Nurse at [the Hospital], you engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional with respect to your care and treatment of [client “A”], and in particular, you made inappropriate comments and/or behaved abruptly and/or harshly with respect to your treatment of the client.
You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(7) of Ontario Regulation 799/93, in that on or about April 27, 1999, while employed as a Registered Practical Nurse at [the Hospital], you abused a client verbally, and/or emotionally, namely, [client “A”].
You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the Nursing Act, 1991, S.O. 1991, c. 32, as amended, and defined in subsection 1(1) of Ontario Regulation 799/93, in that on or about May, 1999, while employed as a Registered Practical Nurse at [the Hospital], you contravened a standard of practice of the profession or failed to meet the standards of practice of the profession with respect to your care and treatment of [client “B”], and in particular, you moved the client ‘s leg in a harsh, rough or inappropriate manner.
You have committed an act of professional misconduct as provided by subsection 51(1)(c) of the Health Professions Procedural Code of the [Nursing Act, 1991, S.O. 19
