DECISION
Adjudicator: Tracy Foster
Date: December 11, 2025
Citation: 2025 CFSRB 183
Indexed as: EM v The Children’s Aid Society of the Niagara Region (CYFSA s.120)
OVERVIEW
1This is an Application filed under section 120 and section 119 of the Child, Youth and Family Services Act, 2017, S.O. 2017, c.14, Sched.1, (the “Act”).
2The Applicant is the father of the child named in the Application.
3In addition to this Application against the Respondent (The Children’s Aid Society of the Niagara Region), the Applicant also filed another CFSRB Application against Hamilton Child and Family Supports, file CA25-0215. The complaint details and support materials provided for both Applications are identical and do not separate out the allegations made against each of the societies.
4This decision explains why the Application does not contain sufficient information for the CFSRB to determine eligibility.
ISSUE
5The issue is:
a. Does the Application contain sufficient information for the CFSRB to determine eligibility?
RESULT
6The CFSRB finds that the Application does not contain sufficient information for it to determine eligibility.
ANALYSIS
7Section 120(4) of the Act sets out matters that the CFSRB may review. These matters relate to complaints made against a particular society.
8As noted above, the Applicant filed separate Applications against two different societies. However, the documentation containing his complaints and other support materials are identical in both Applications. This Application (CA25-0216) does not separate out the allegations against the Respondent.
9Therefore, the Application contains insufficient information for the CFSRB to determine which complaints against the Respondent and the CFSRB is unable to determine whether the Application is eligible to proceed.
ORDER
10The Application is dismissed.
CONFIDENTIALITY ORDER
11Pursuant to Rules 9.3 and 9.4 of the CFSRB’s Rules of Procedure, parties and their representatives must not use, share, discuss or disclose any CFSRB documents or decisions or any other documents or information provided or used in this Application with anyone, including through the media or online. The CFSRB prohibits the use of any of this information for any purpose outside of the CFSRB’s proceedings, except with an order of the Court or the CFSRB, as appropriate.
