BETWEEN:
AA Applicant
-and-
Tikinagan Child and Family Services Respondent
DECISION
Adjudicator: Catherine Bickley Date: February 7, 2023 Citation: 2023 CFSRB 5 Indexed As: AA v Tikinagan Child and Family Services of Waterloo Region (CYFSA s.120)
INTRODUCTION
1This is an Application filed with the Child and Family Services Review Board (“CFSRB”) pursuant to section 109 of the Child, Youth and Family Services Act, 2017, SO 2017, c.14, Sched.1, (the “Act”).
BACKGROUND
2LK has lived with the Applicant continuously since October 2012 except for about one month in 2022. The Applicant describes herself as LK’s foster parent.
3Because it was not clear from the Application whether LK was in extended society care and whether the Applicant had received appropriate notice of LK’s proposed removal, the CFSRB scheduled a Case Management Teleconference.
4During the February 6, 2023 Case Management Teleconference the parties clarified that LK is not in extended society care.
ANALYSIS
5As LK is not in extended society care, the CFSRB lacks jurisdiction to review the Application (see SM v. Dilico Anishinabek Family Care, 2019 CFSRB 28).
ORDER
6The Application is dismissed.
CONFIDENTIALITY ORDER
7Pursuant to Rules 9.3 and 9.4 of the CFSRB’s Rules of Procedure parties and their representatives must not use, share, discuss or disclose any CFSRB documents or decisions or any other documents or information provided or used in this Application with anyone including through the media or on-line. The CFSRB prohibits the use of any of this information for any purpose outside of the CFSRB’s proceedings, except with an order of the Court or the CFSRB, as appropriate.
