Introduction

1The Applicant and the Kawartha-Haliburton Children’s Aid Society (the Respondent) entered into a Settlement Agreement during a mediation held March 29, 2018. The agreement provided a full settlement of all issues raised by the Applicant in his application to the Child and Family Services Review Board (CFSRB) dated September 26, 2017.

2The Settlement Agreement between the parties provided for an implementation date of April 30, 2018 and a non-compliance date of May 7, 2018.

3On May 7, 2018 the Applicant contacted the CFSRB in writing alleging non-compliance with the Settlement Agreement.

4A hearing by teleconference was held to consider the alleged non-compliance. The parties agreed that I could speak privately with the Applicant to better understand his concerns and because interactions between the Applicant and the Society had been and continued to be highly conflictual.

5In the course of that discussion the Applicant agreed that the Respondent's April 16, 2018 letter addressed the issues in the Settlement Agreement. The Applicant raised an issue that had occurred after the date of the mediation process. I explained this issue was not related to non-compliance with the Settlement Agreement. I told Applicant that he could file a new application about this issue with the CFSRB if he wished.

DECISION

6As the Applicant agrees the Respondent is in compliance with the terms of the Settlement Agreement this file has now been closed as settled.
