WITHDRAWAL ORDER
1The Applicant filed an application with the Condominium Authority Tribunal (CAT). The case proceeded to Stage 2 – Mediation on January 23, 2026. Stage 2 – Mediation ended on April 10, 2026. The case proceeded to Stage 3 – Tribunal Decision on May 11, 2026. The hearing commenced on May 13, 2026. The Applicant alleged they are experiencing loud banging and stomping noises and vibration on the Applicant’s ceiling and walls. The Applicant alleges that the corporation has failed to enforce s. 117 (2) of the Condominium Act, 1998 and the condominium corporation’s governing documents, specifically the condominium corporation’s rules regarding Quiet Enjoyment (s.2).
2Under Rule 19.1 of the CAT’s Rules of Practice, the CAT can close a case in Stage 3 – Tribunal Decision if the Applicant has informed the CAT that they wish to withdraw their case.
3On May 13, 2026 the Applicant informed the CAT that they wish to withdraw their case.
4No submissions or evidence had been provided to the Tribunal in Stage 3 – Tribunal Decision at the time of the withdrawal request.
5The Respondent had no objections to the withdrawal request by the Applicant.
6The CAT accepts the Applicant’s withdrawal, and I order that this case be closed.
ORDER
7The Tribunal orders that:
This case is closed in Stage 3 – Tribunal Decision under Rule 43.1 of the CAT’s Rules of Practice.
All messages and any documents that contain settlement‑related messages or settlement offers that were shared in Stage 1 – Negotiation and/or Stage 2 – Mediation of this case are private and confidential. That means that the Users cannot share, or tell anyone about, messages or documents they received from other Users without the permission of the other User.
The Users may share a copy of any document they received during the course of this case if required by law, such as to a government organization or a court.
