MOTION ORDER
1(George) Kai Sin Yeung (“the Applicant”), is an owner in Metropolitan Toronto Condominium Corporation No. 1136 (“the Respondent”). In December 2020 the Tribunal ordered that the Applicant must obtain permission from the Tribunal before filing any new applications after being found to have used the Tribunal for an improper purpose. Subsequently, the Tribunal denied permission to file applications in 2021 and 20221.
2On October 17, 2025, the Applicant requested permission to submit a new application.
3Mr. Yeung identified that he had submitted a records request, that the corporation had responded, and that there was a genuine dispute over the board’s refusal to provide records.
4The Tribunal requested submissions from the Respondent. The Respondent opposed the motion. They provided justification for their refusal to provide the records. They pointed to ongoing legal proceedings between the Applicant, and directors of the corporation.
5They also opposed the request because the application was too late, stating that:
The Applicant filed his request to file a new case with the CAT on October 17, 2025. Under s. 13.10(b) of O. Reg 48/01 to the Condominium Act, 1998 (the “Act”), the Applicant was required to file a CAT application within 60 days after receiving the Board Response to. The Board Response in this case was provided on August 15, 2025. As such, the request for records is deemed abandoned and of no force and effect under s. 13.10(b) of O. Reg 48/01.
6I agree that this application is too late. The Applicant contacted the Tribunal after the 60-day period. Therefore, the request is deemed abandoned. The Tribunal would not accept the Application (regardless of the restrictions) based on it being abandoned. I do not need to address the specific request to file an application in these circumstances.
ORDER
7The motion is dismissed.
