CONSENT ORDER
1A case was brought to the CAT by Angelita Lim. She alleges violations of rules regarding pets and violations of condominium by laws and rules respecting noise, by the Respondent Victoria Mico, which are contrary to the governing documents of Toronto Standard Condominium Corporation No. 1791 (“TSCC 1791”).
2TSCC 1791 maintains it is aware of its obligations to investigate violations and enforce the provisions of its governing documents.
3Victoria Mico agrees to abide by TSCC 1791’s declaration, by laws and rules regarding pets and noise.
4With the consent of all the Parties, the CAT orders that this case has been resolved, based upon the terms and conditions set out in this consent order.
5This Tribunal Orders: on a going forward basis, should Angelita Lim make any complaints to TSCC 1791 regarding either noise or pets relating to Victoria Mico or her unit, the condominium corporation shall investigate her complaints and inform her of any decisions it makes.
6If there is a further complaint from Angelita Lim regarding either noise or pets relating to Victoria Mico, or her unit, the condominium corporation shall consider steps to remedy the situation, which may include sending an enforcement letter to Victoria Mico, and imposing enforcement costs. The condominium corporation will advise Angelita Lim of any such decisions.
7The Parties have agreed to a Consent Order that resolves all the current issues in dispute. This case is closed in Stage 2 – Mediation under Rule 34.3 of the CAT’s Rules of Practice.
