DISMISSAL ORDER
1In communication with the Tribunal, the Applicant asserted that if this application is dismissed, it would “be an absurd result that undermines the purpose of the act.” This order explains that it is not absurd - the CAT does not have the legal authority to decide the case.
2The Tribunal’s jurisdiction is set out in regulations1 by the Ontario government. It cannot accept an application where there is no authority to deal with the issue. The CAT can hear disputes with respect to chargebacks and indemnity provisions only if they relate to disputes within the CAT’s jurisdiction. These include Pets; Vehicles; Parking; Storage; and specific Nuisances.
3The dispute is about a chargeback related to a door replacement. This is a dispute about repairs and maintenance. The CAT does not deal with every type of chargeback. The CAT does not deal with repairs and maintenance.
4The Tribunal advised the Applicant of the concerns around jurisdiction. The Tribunal issued a Notice of Intent to Dismiss the Application. The Applicant’s reply submissions included a series of bold assertions about the tribunal, and the consequences of failing to accept the case. The Applicant did not respond to any of the substantive concerns raised by the Tribunal.
5The CAT must dismiss this Application because it does not have the legal authority to decide the issues.
ORDER
6The Tribunal orders the Application dismissed.
