MOTION ORDER
1The Applicant requested the Tribunal reopen a case, under the CAT Rules after the case closed in Stage 1 – Negotiation. The case closed automatically after 30-days of inactivity. The Applicant stated that the case closed because he lost access to the case due to a change in email address.
2The Respondent replied to the motion before the CAT could ask for submissions. The Respondent indicated that the Applicant had used the email address at the time in question.
3I am satisfied that the Applicant has a genuine desire to engage with the case, and that if I do not allow it to be reopened, the Applicant can submit a new Application on the same grounds. It would be less of a burden on all parties to allow the case to resume in Stage 1 – Negotiation.
4Prior to reopening the case, the email address issue must be resolved. The Applicant must contact Tribunal Staff within 14 days of this Order to update their CAO account. If the Applicant does not complete this stage, the case will remain closed.
ORDER
5Within 14 days of this Order, the Applicant must contact Tribunal Staff to update their CAO account. If the Applicant does not complete this stage, the case will remain closed.
6If the Applicant does complete the process to update the Account, the case will be resumed in Stage 1 – Negotiation.
