DISMISSAL ORDER
1This application is dismissed because it is about issues the CAT cannot decide. It is about a chargeback, York Condominium Corporation No. 180 (the Respondent, “YCC 180”) applied for repairs to the common elements related to flooding in the Owner’s basement. The Applicant owns a unit in YCC 180.
2The CAT does not have the legal authority to deal with every chargeback dispute. The Tribunal’s jurisdiction is set out in Ontario Regulation 179/17. The Tribunal may only consider matters that fall within this jurisdiction. The CAT can deal with chargebacks related to issues that fall within the jurisdiction, such as pets, vehicles, parking, storage, and specific nuisances.
3The issues raised in the application relate to a chargeback for repairs to the Owner’s basement due to a flood, which do not fall within the Tribunal’s jurisdiction.
4The Applicant was advised of the jurisdictional concern. The application was resubmitted; however, it reiterated the same issues and did not provide any additional information to assist the Tribunal in assessing the matters raised or in establishing that they fall within its jurisdiction.
5The Tribunal issued a Notice of Intent to Dismiss the Application. The applicant did not make any submissions with respect to the Notice. The issues that make up this dispute are not within the jurisdiction of the CAT.
ORDER
- The Tribunal orders the case dismissed.
