DISMISSAL ORDER
1This order explains why this application is dismissed. The CAT has no legal authority to decide the issues in this application. The application is about a dispute related to a chargeback following a pluming leak in the Applicant’s unit.
2Under Ontario Regulation 179/17, the Tribunal has the authority to hear disputes about indemnification/compensation so long as there is such a provision in the condominium corporation’s governing documents, and the charge is in relation to one of the following:
- Pets and animals, vehicles, parking and storage;
- Noise, odour, light, vibration, smoke and vapour;
- Another type of nuisance, annoyance or disruption set out in the condominium corporation’s governing documents.
3The Applicant was informed of this twice and has not identified such a provision, nor does the cause for the chargeback fall within the Tribunal’s jurisdiction as set out in Ontario Regulation 179/17.
4The Tribunal issued a Notice of Intent to Dismiss the Application. The Applicant responded to the Notice; however, the response appeared to have been written with the use of generative AI. The response did not contain hallucinations in the form of fake cases, but it ignored all of the issues identified in the Notice. Instead, it forcefully recounted sections of the Act that were relevant to the dispute. The response failed to identify any aspects of the dispute which would be considered within the Tribunal’s jurisdiction.
5This dispute is about chargebacks following a leak. The Tribunal does not have the power to decide this application. I order that this case be dismissed.
ORDER
- The Tribunal orders the application dismissed.
