DISMISSAL ORDER
1This application is dismissed because the Tribunal does not have the legal authority to decide the issues in dispute. The application was filed under the CAT’s nuisance jurisdiction against Toronto Standard Condominium Corporation No. 2940 (“TSCC 2940”, the Respondent) alleging the charge back to his unit was unreasonable. The Applicant is a unit owner in TSCC 2940.
2It appears that the corporation charged the Applicant $4,621.46 to repair his unit following a water leak. According to the Problem Description, the Applicant believes the chargeback should be reversed.
3This is a chargeback related to a repair and maintenance issue, not a nuisance.
4The Tribunal issued a Notice of Intent to Dismiss the case and gave the Applicant an opportunity to explain if the case should be accepted. The response cited several sections of the condominium act but did not provide information to confirm the dispute fell within the scope of issues the CAT can decide as outlined in Ontario Regulation 179/17.
5The Tribunal does not have the authority to decide disputes about every type of chargeback. The issues that make up this dispute are not within the jurisdiction of the CAT.
ORDER
- The Tribunal orders the Application is dismissed.
