CASE: 2023-00713N

The Applicant, Balraj Khuman Self-Represented
The Respondent, Toronto Standard Condominium Corporation No. 2481 Represented by Jessica Hoffman, Counsel
DISMISSAL ORDER
1The Applicant filed a case with the Condominium Authority Tribunal (CAT) about the infiltration of the smell of smoke in his unit. The claim is that the Respondent has not taken reasonable steps despite ongoing investigative efforts and fining owners caught violating the condominiums’ smoking rules and by‑laws. The dispute proceeded to Stage 2 – Mediation on March 5, 2024.
2On July 3, 2024, the Applicant was permitted to move the matter to Stage 3 – Tribunal Decision, as the mediation discussions had reached an impasse.
3Under Rule 34.3 of the CAT’s Rule of Practice, the CAT can close a case in Stage 2 – Mediation if the Applicant does not move their matter to Stage 3 – Tribunal Decision after having the opportunity to do so for more than 15 days.
4The Applicant has been offered the opportunity to go to Stage 3 – Tribunal Decision, in which he has not taken steps to do so or paid the fee needed to move his matter forward. Therefore, I am ordering this case be closed per Rule 34.3.
ORDER
5The Tribunal orders that:
This matter is closed in Stage 2 – Mediation under Rule 34.3 of the CAT’s Rules of Practice.
