DISMISSAL ORDER
1The Applicant filed an application with the Condominium Authority Tribunal (CAT) against the Respondent condominium corporation. The case went to Stage 2 – Mediation on December 15, 2021.
2The Applicant has not participated on the CAT-ODR Platform since December 21, 2021.
3On January 12, 2022, I issued a Notice of Intent to Dismiss due to the lack of activity. The Applicant had until January 21, 2022, to make submissions if they wished to continue the case. No submissions were made.
4Rule 11.2 of the CAT’s Rules of Practice require parties to CAT cases to check the CAT-ODR system at least once every weekday, or as directed by the CAT.
5Rule 34.3(d) of the CAT’s Rules of Practice allows a case to be considered abandoned when there has been no discussion on the CAT-ODR system for more than 15 days.
6As a courtesy, a CAT Information and Tribunal Analyst contacted the Applicant by email and voicemail about this case. I am satisfied that the Applicant was given sufficient notification to log into the CAT-ODR system and monitor the case.
7The nature of this case appears well suited to mediation. Mediation cannot take place without the Applicant’s participation. As the Applicant has not participated on the CAT-ODR system for a month, I find that the Applicant has abandoned this case.
ORDER
8The Tribunal orders this case to be dismissed.
