O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a teleconference pre-hearing on June 17, 2011, pursuant to Notice of Proposal (“NOP”) number 18629 dated April 6, 2011 to review an application for a liquor sales licence made by Corporation of the Town of Smiths Falls (the “Applicant”), operating or intending to operate as SMITHS FALLS MEMORIAL COMMUNITY CENTRE, 71 Cornelia Street West, Smiths Falls, Ontario, K7A 4S4, establishment number 814813;
AND WHEREAS the Registrar’s Representative, Rena Khan, the Applicant’s Representative, Shane Kelford, and TriCounty Addiction Services Representative, Sara Hammel were present and participated in the pre-hearing;
AND WHEREAS Ms Hammel requested party status in this matter, on behalf of TriCounty Addiction Services, which request was opposed by the Applicant;
AND WHEREAS Ms Khan advised that the Registrar was not taking a position with respect to this matter;
AND WHEREAS this matter is scheduled for a hearing commencing June 24, 2011 in Smiths Falls;
AND WHEREAS the Board heard submissions regarding the request for party status;
THEREFORE the Board hereby ORDERS as follows:
TriCounty Addiction Services is hereby granted party status as an objector;
TriCounty Addiction Services, through Ms Hammel, shall disclose to the parties pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2; said disclosure to be made by 5 p.m. on July 20, 2011;
The Applicant, through Mr. Kelford, shall disclose to the parties pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2; said disclosure to take place by 12 p.m. (noon) on June 21, 2011.
