681311 ONTARIO LIMITED OPERATING AS SHOTS SPORTS TAP & GRILL,

AMENDED ORDER
WHEREAS a hearing into Notice of Proposal number 16034 dated February 19, 2008 and an Amended Notice of Proposal number 16613 dated September 8, 2008 to suspend liquor licence number 91379 issued to 681311 Ontario Limited (the “Licensee”), operating as SHOTS SPORTS TAP & GRILL, 185 Pembroke Street East, Pembroke, Ontario, K8A 3J6, on the basis of alleged violations of section 29 and subsection 45(1) and 45(2) of the Liquor Licence Act (the “LLA”) and section 45.1 and subsections 34(1) and 45(1) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the LLA, was held on September 10, 11, 12 and November 21, 2008, and February 18 and 19 , and May 25, 2009 in Ottawa (Kanata), Ontario;
AND WHEREAS in its decision of July 13, 2009 the Board found that the Licensee had violated subsection 45(1) of the LLA and subsection 34(1) of the O.Reg;
AND WHEREAS in its decision of September 25, 2009 the Board ordered a TEN (10) day suspension of the liquor licence;
AND WHEREAS in its Order of October 22, 2009 the Board ordered the suspension period to be served from 11:00 a.m. on November 1, 2009 until 2:00 a.m. on November 11, 2009;
AND WHEREAS the Licensee appealed the Board’s Decision to the Ontario Superior Court of Justice (“Divisional Court”) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Order dated April 5, 2011;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 91379 issued to 681311 Ontario Limited, operating as SHOTS SPORTS TAP & GRILL, 185 Pembroke Street East, Pembroke, Ontario, K8A 3J6, be SUSPENDED for TEN (10) consecutive days to commence at 11:00 a.m. on August 28, 2011 and continue until 2:00 a.m. on September 7, 2011.
