Allegations
- A hearing into Notice of Proposal number 18332 dated October 6, 2010 to revoke liquor licence number 25762 (the “licence”) issued to Eunice Maricel Sunga-Victoria (the “Licensee”) operating as ARISTOKRAT BBQ RESTAURANT, 355 Wilson Avenue, North York, Ontario, M3H 1T3, on the basis that the Licensee is disentitled to a licence under clauses 6(2)(a), 6(2)(d), and 6(2)(f) of the Liquor Licence Act (the “LLA”), was held on April 13, 2011 in the City of Toronto.
Decision and Reasons
The Registrar and the Licensee, through their legal counsel, presented evidence and submissions on this matter.
During the evidence of one of the Licensee’s witnesses, Mrs. Cecile Sunga, it was revealed that the Licensee did not file to renew its licence, which expired on March 1, 2011.
After listening to submissions, the panel asked Mr. Policelli to confirm whether the licence had in fact expired. After a brief recess, Mr. Policelli informed the Panel that the licence was cancelled on March 9, 2011.
Accordingly, the Panel found that it had no jurisdiction to make a finding under clauses 6(2)(a), 6(2)(d), and 6(2)(f) of the LLA and concluded the matter.
