O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on February 11, 2011, pursuant to Notice of Proposal (“NOP”) number 17947 dated March 18, 2010 to suspend liquor licence number 24202 issued to Joe Kool’s Restaurants Limited (the “Licensee”) operating as JOE KOOL’S RESTAURANT, 595 Richmond Street, London, Ontario, N6A 3G2;
AND WHEREAS the Registrar’s Representatives, Richard Kulis and Lorenzo Policelli, and the Licensee’s Representative, Michael Lerner, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing February 22, 2011;
AND WHEREAS Mr. Kulis and Mr. Lerner jointly requested that the hearing be adjourned pending the outcome of a motion for a stay of proceedings in NOP # 16156 to be heard on April 8, 2011 in the Superior Court of Justice (Divisional Court);
AND WHEREAS the legal issue raised in NOP # 16156 in which judicial review is being sought is also in issue in this matter;
THEREFORE the Board hereby ORDERS as follows:
The hearing in this matter is adjourned sine die pending the outcome of the motion referred to above;
A further pre-hearing in this matter will be held on April 15, 2011 at which the Board will, if the motion for a stay is unsuccessful, schedule the hearing date for this matter or alternatively, consider a stay of this matter pending further review proceedings before the Courts.
