O R D E R
WHEREAS a hearing into Notice of Proposal number 18113 ("NOP") dated June 4, 2010 to suspend liquor licence number 805164 issued to Rockwood Nightclub Inc. ("Licensee") operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V 1H2, on the basis of an alleged violation of subsection 45(1) of Ontario Regulation 719/90 (the "O.Reg."), prescribed under the Liquor Licence Act (the "LLA"), was held in the City of Toronto on September 21, 2010;
AND WHEREAS in its decision of October 29, 2010 the Board found that the Licensee had breached subsection 45(1) of the O.Reg.;
AND WHEREAS in its decision of December 20, 2010 the Board ordered a TWENTY-ONE (21) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 805164 issued to Rockwood Nightclub Inc. operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V 1H2, be SUSPENDED for TWENTY-ONE (21) consecutive days to COMMENCE at 11:00 a.m. on January 9, 2011 and continue until 2:00 a.m. on January 30, 2011.
