O R D E R
WHEREAS a hearing into Notice of Proposal number 17997 (“NOP”) dated April 12, 2010, to suspend liquor licence number 91000 issued to 1704477 Ontario Inc. (“Licensee”) operating as CANE GROVE RESTAURANT, 2356 Finch Avenue West, Toronto, Ontario, M9M 2C7, on the basis of alleged violations of conditions on the licence pursuant to the Liquor Licence Act (the “LLA”) was held on September 23, 2010 in the City of Toronto;
AND WHEREAS in its decision of October 4, 2010 the Board found that the Licensee had breached conditions on the licence pursuant to the LLA;
AND WHEREAS in its decision of December 20, 2010 the Board ordered a TWO (2) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS on or about December 20, 2010, the Board was informed that liquor licence number 91000 was subject to an administrative revocation for premises closed on or about December 1, 2010, pursuant to section 56 of the Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the LLA;
THEREFORE, in these particular circumstances, the Board will not set suspension dates as to do so would be moot; however, should the Registrar’s Order of Revocation be rescinded, the Board will set suspension dates upon request to do so by any one of the parties.
