AND IN THE MATTER OF THE LIQUOR LICENCE OF
ROCKWOOD NIGHTCLUB INC., OPERATING AS ROCKWOOD/GRASS, 31 MERCER STREET, TORONTO LICENCE NUMBER 805164
O R D E R
WHEREAS a hearing into Notice of Proposal number 17306 ("NOP") dated June 12, 2009 to suspend liquor licence number 805164 issued to Rockwood Nightclub Inc. ("Licensee") operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V 1H2, on the basis of an alleged violation of subsection 45(1) of Ontario Regulation 719/90 (the "O.Reg."), prescribed under the Liquor Licence Act (the "LLA"), was held on September 24, 2009, in the City of Toronto;
AND WHEREAS in its decision of November 5, 2009 the Board found that the Licensee had breached subsection 45(1) of the O.Reg.;
AND WHEREAS in its decision of December 17, 2009 the Board ordered a FOURTEEN (14) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee appealed the Board's decisions of November 5 and December 17, 2009 and obtained a stay of the Order of Suspension, which appeal was, on January 5, 2011, dismissed on consent of the parties and the stay lifted;
AND WHEREAS the Licensee has now proposed dates on which to serve its suspension, which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 805164 issued to Rockwood Nightclub Inc. operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V 1H2, be SUSPENDED for FOURTEEN (14) consecutive days to COMMENCE at 2 a.m. on January 30, 2011 and continue until 2:00 a.m. on February 13, 2011.
