Allegations
- A hearing into a Notice of Proposed Order (“NOPO”) dated July 23, 2009 to suspend for two weeks the registration of LORETTA LYNN SANDY (the “Registrant”), 390 Sundial Drive, Suite 308, Orillia, Ontario, L3V 4A6, as a gaming assistant, in the class of gaming employee, registration number 108367, on the basis under section 12 of the Gaming Control Act, 1992 (the “GCA”) that there are reasonable grounds to believe that the Registrant has not acted in accordance with the law, or with integrity, honesty, or in the public interest, having regard to the past conduct and the Registrant has carried on activities in contravention of the GCA or regulations or the terms of the registration, was held on December 22, 2009 in the Town of Orillia.
Preliminary Matters
- The Registrant appeared on her own behalf, was advised by the Board that she could have a representative act for her at the hearing which she acknowledged, and waived her right to such representation.
Decision
After discussion between the Registrar’s Representative and the Registrant, it was agreed that if certain terms and conditions were immediately added to the Registrant’s registration with the Alcohol and Gaming Commission of Ontario, the Registrar would not seek any suspension of the Registrant’s registration.
The terms and conditions are the following:
a) Registrant shall notify the Registrar in writing within 10 days when the consumer proposal has been completed;
b) Registrant shall notify the Registrar in writing within 10 days if a proposal in bankruptcy has been filed; and
c) Registrant shall notify the Registrar in writing within 10 days when the discharge from condition (b) above has been made.
- The Registrant agreed that those terms and conditions were acceptable to her and that she understood them.
Order
- The Board ORDERS that the following terms and conditions be added to the gaming assistant registration of LORETTA LYNN SANDY, 390 Sundial Drive, Apartment 308, Orillia, Ontario, L3V 4A6, being registration number 108367:
a) Registrant shall notify the Registrar in writing within 10 days when the consumer proposal has been completed;
b) Registrant shall notify the Registrar in writing within 10 days if a proposal in bankruptcy has been filed; and
c) Registrant shall notify the Registrar in writing within 10 days when the discharge from condition (b) above has been made.
