O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing tele-conference on January 18, 2009, pursuant to Order of Monetary Penalty (“OMP”) number 193 dated December 22, 2009, issued to 1609559 Ontario Ltd. (the “Licensee”), operating as CLUB KAOS, 107 Kennedy Road South, Brampton, Ontario, L6W 3G3, liquor licence number 21019 (the “Licence”), pursuant to section 14.1 of the Alcohol and Gaming Regulation and Public Protection Act, 1996, in respect of alleged violations of subsections 35(1) and 45(1) of Ontario Regulation 719/90, made pursuant to the Liquor Licence Act;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and Bibi Deodat, principal of the corporate licensee, were present and participated in the pre-hearing;
AND WHEREAS this OMP matter will be heard at a hearing as yet to be scheduled;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
