AND IN THE MATTER OF THE LIQUOR LICENCE OF
2088675 ONTARIO INC., OPERATING AS ZU BAR 4170 SOUTH SERVICE ROAD, BURLINGTON LICENCE NUMBER 200843
O R D E R
WHEREAS the Registrar of the Alcohol and Gaming Commission of Ontario ("AGCO") issued Notice of Proposal ("NOP") number 16993 dated January 23, 2009, to suspend liquor licence number 200843 issued to 2088675 Ontario Inc. (the "Licensee"), operating as ZU BAR, 4170 South Service Road, Burlington, Ontario, L7L 4X5, on the basis of an alleged violation of subsection 45(1) of Ontario Regulation 719/90 made pursuant to the Liquor Licence Act;
AND WHEREAS this NOP matter is scheduled for a hearing commencing January 21, 2010;
AND WHEREAS the Manager of Hearings department received a letter from Joyce Taylor dated January 12, 2010 requesting that the Board issue an Order of Disclosure with respect to two of the witnesses who the Licensee intends to call at the hearing;
AND WHEREAS Mr. Chand, counsel for the Licensee has since provided a witness statement for one of the witnesses and advised that there is no witness statement for the third witness;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a detailed summary of the remaining witness' proposed evidence, as well as any disclosure pursuant to Rule 10.2, such disclosure to be made by January 18, 2010;
The Registrar's Representative will complete any further disclosure, also pursuant to Rule 10.2, by January 18, 2010.
