AND IN THE MATTER OF THE LIQUOR LICENCE OF
2136627 ONTARIO INC., OPERATING AS WILD WING WASAGA BEACH 321 MAIN STREET, WASAGA BEACH LICENCE NUMBER 812803
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on June 25, 2010, pursuant to Notice of Proposal (“NOP”) number 18079 dated May 19, 2010 to suspend liquor licence number 812803 issued to 2136627 Ontario Inc. (the “Licensee”) operating as WILD WING WASAGA BEACH, 321 Main Street, Unit 3, Building F, Wasaga Beach, Ontario, L9Z 0B6;
AND WHEREAS the Registrar’s Representatives, Bryna Kaplan and Sandra Lucas, and the principal of the corporate licensee, Mary Ann Watts Cuzzilla, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is to be scheduled for a two day hearing;
AND WHEREAS Ms Watts Cuzzilla has stated that she has not retained legal representation but has undertaken to advise the Board and the Registrar’s Representative forthwith should she retain a representative;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date;
Further, should the Registrar retain an expert toxicologist, the Registrar’s Representative shall provide disclosure as soon as possible, but not later than the time prescribed in Rule 12.
