O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on July 22, 2010, pursuant to Notice of Proposal (“NOP”) number 18142 dated June 14, 2010 to review an application for additional licensed areas for liquor licence number 800239 issued to 2092833 Ontario Inc. (the “Licensee”) operating as TIME NIGHT CLUB, 81 Peter Street, Toronto, Ontario M5V 2G4;
AND WHEREAS the Registrar’s Representative, Phillip Morris, the Licensee’s Representative, Jerry Levitan, the Representative for the City of Toronto, Ray Kallio, and the Representative for the King-Spadina Resident’s Association (“KSRA”), Wayne Scott, were present and participated in the pre-hearing;
AND WHEREAS the City of Toronto requested party status in respect of this matter;
AND WHEREAS the KSRA requested party status in respect of this matter;
AND WHEREAS Mr. Levitan and Mr. Morris did not object to the requests for party status;
AND WHEREAS Mr. Morris advised that the Registrar is currently not taking a position with respect to the application, but would advise forthwith should that position change;
AND WHEREAS this NOP matter is scheduled for a hearing commencing August 30, 2010;
THEREFORE the Board hereby ORDERS as follows:
The City of Toronto is hereby granted party status, as intervenor;
The KSRA is hereby granted party status;
The City of Toronto, through its Representative, shall disclose pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2. The Board notes Mr Kallio’s undertaking to use his best efforts to provide earlier disclosure, specifically by end of day August 13, 2010;
The KSRA, through its Representative, shall disclose pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Licensee, through its Representative, shall disclose pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
