O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on September 13, 2010, pursuant to Notice of Proposal (“NOP”) number 18101 dated May 27, 2010 to suspend liquor licence number 202387 issued to Blue Nile Restaurant Ltd., (the “Licensee”) operating as BLUE NILE RESTAURANT, 1260 Danforth Ave., Toronto, Ontario, M4J 1M6;
AND WHEREAS the Registrar was represented by its counsel, Don Bourgeois, and neither a representative for the Licensee nor the Licensee was present for the pre-hearing conference although the Licensee had been duly notified;
AND WHEREAS this NOP matter is scheduled for a hearing commencing October 25, 2010;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made no less than ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, no less then (10) days before the hearing date.
