O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on May 31, 2010, pursuant to Notice of Proposal (“NOP”) number 17732 dated December 9, 2009 to suspend a licence, NOP number 18009 dated April 21, 2010 to revoke a licence, NOP number 17766 dated December 17, 2009 to review an application for additional licensed areas and supplementary NOP number 18010 dated April 21, 2010 to review an application for additional licensed areas for liquor licence number 800485 issued to 1672750 Ontario Inc. operating as SILVER CITY BAR & GRILL, 780 Danforth Avenue, Toronto, Ontario, M4J 1L5;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Pradeep Chand, were present and participated in the pre-hearing;
AND WHEREAS these NOP matters have not yet been scheduled for a hearing;
THEREFORE the Board hereby ORDERS as follows:
NOPs 17732 and 18009 will be joined, to be heard together with the hearing to be scheduled for five days with further dates to be scheduled as required;
NOPs 17766 and 18010 will be joined, the hearing of those matters will take place after a decision is rendered on NOPs 17732 and 18009;
A further pre-hearing will be scheduled to take place in or about two weeks prior to the first hearing date set for NOPs 17732 and 18009;
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure is to be completed ten (10) days before the scheduled pre-hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the scheduled pre-hearing date.
