475687 ONTARIO LIMITED OPERATING AS HORSESHOE TAVERN,
368 QUEEN STREET WEST, TORONTO

AMENDED ORDER
WHEREAS a hearing into Notice of Proposal number 16864 dated November 24, 2008, to suspend liquor licence number 90103 of 475687 Ontario Limited (the “Licensee”) operating as HORSESHOE TAVERN, 368 Queen Street West, Toronto, Ontario, M5V 2A2, on the basis of alleged violation of section 29 of the Liquor Licence Act (the “LLA”) and subsection 45(1) of Ontario Regulation 719/90 (the “O.Reg”) prescribed under the LLA, was held on April 6, 2009 in the City of Toronto;
AND WHEREAS in its decision dated April 23, 2009 the Board found the Licensee violated section 29 of the LLA and subsection 45(1) of the O.Reg in respect of one patron;
AND WHEREAS in its decision of May 20, 2009 the Board ordered a SIX (6) day suspension of the liquor licence;
AND WHEREAS in its Order of June 8, 2009 the Board ordered the suspension period to be served from 11:00 a.m. on August 9, 2009 until 2:00 a.m. on August 15, 2009;
AND WHEREAS the Licensee appealed the Board’s Decision to the Ontario Superior Court of Justice (“Divisional Court”) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Order dated June 11, 2010;
AND WHEREAS the Licensee has proposed new suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 90103 of 475687 Ontario Limited operating as HORSESHOE TAVERN, 368 Queen Street West, Toronto, Ontario, M5V 2A2, be SUSPENDED for SIX (6) consecutive days to COMMENCE at 11:00 a.m. on August 21, 2010 and continue until 2:00 a.m. on August 27, 2010.
