O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on April 9, 2010, pursuant to Notice of Proposal (“NOP”) number 17908 dated February 26, 2010 to suspend liquor licence number 203408 issued to 1802769 Ontario Inc. (the “Licensee”) operating as SWIGGZ, 1 Government Road East, Kirkland Lake, Ontario, P2N 1A1;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and Eric Legault, the principal of the corporate Licensee, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing May 5th, 2010;
THEREFORE the Board hereby ORDERS as follows:
The Licensee shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made no less than fourteen (14) days before the hearing date;
Without limiting the foregoing and no less than fourteen (14) days before the hearing, the Licensee shall provide the Registrar’s Representative with a copy of all pages of its incident log relating to the alleged incidents set out in the NOP, a copy of the false identification of the youth in question, and a copy of any further written statements made by the said youth (if any) that come into the Licensee’s possession;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
