AND IN THE MATTER OF THE LIQUOR LICENCE OF
1758944 ONTARIO INC., OPERATING AS STRANGELOVE 587 COLLEGE STREET, TORONTO LICENCE NUMBER 808547
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a tele-conference pre-hearing on April 23, 2010, pursuant to Notice of Proposal (“NOP”) number 17866 dated February 10, 2010 to suspend liquor licence number 808547 issued to 1758944 (the “Licensee”) operating as STRANGELOVE 587 College Street, Toronto, Ontario, M6G 1B2;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Pradeep Chand, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing June 9, 2010;
AND WHEREAS additional NOPs have been issued as follows: NOP # 17418 (issued on March 27, 2009) scheduled for a hearing on May 28, 2010, NOP # 17756 (issued on December 16, 2009) scheduled for a hearing on July 12, 2010, and NOP # 17978 to revoke a licence (issued on April 15, 2010), as yet not scheduled for a hearing date;
THEREFORE the Board hereby ORDERS as follows:
On consent of the parties, the NOPs (# 17418, 17756, 17866 and 17978) are to be joined, to be heard together commencing on May 28, 2010 (subject to counsel’s availability) and to continue on June 9, 2010 with three further hearing dates to be scheduled in the month of June;
Mr. Morris and Mr. Chand are to provide their availability for June hearing dates to the Hearings Office forthwith;
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the first hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the first hearing date.
