O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on February 19, 2010, pursuant to an appeal of Order of Monetary Penalty (“OMP”) number 189 dated January 4, 2010, issued to Pomerix Inc. operating as ROCK AND ROLL HEAVEN BAR AND RESTAURANT EAST, 1660 O’Connor Drive, Toronto, Ontario, M4A 1W4, liquor licence number 25950;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and Steve Stanley, General Manager, on behalf of the Licensee, and were present and participated in the pre-hearing;
AND WHEREAS the appeal for this OMP is scheduled to commence on March 18, 2010;
THEREFORE the Board hereby ORDERS as follows:
The principal of the Licensee, Mr. Mistry, is to provide to the Hearings office on or before March 10, 2010, a letter authorizing Mr Stanley to represent the licensee, or if a legal representative is retained, written notice to that effect with the representatives contact information;
The Licensee, or through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10, ten (10) days before the hearing date.
