O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario held a pre-hearing conference on February 19, 2010, pursuant to Notice of Proposal (“NOP”) number 17705 dated November 15, 2009 to revoke liquor licence number 801597 issued to The Deck Inc. (the “Licensee”), operating as THE DECK PUB & GRILL, 34 Mills Street, Orangeville, Ontario, L9W 2M3;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Robert Isles, together with Tim Callaghan, the principal of the Licensee, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing March 8, 2010, through to March 12, 2010;
AND WHEREAS Mr. Isles has requested an adjournment of the hearing due to his unavailability and ongoing disclosure issues;
AND WHEREAS Mr. Kulis provided clarification and further disclosure such that Mr. Isles confirmed at the pre-hearing that the disclosure issues previously raised were resolved to his satisfaction;
THEREFORE the Board hereby ORDERS as follows:
The hearing of evidence on matters alleged in this NOP will be adjourned to a date to be set by the Manager of Hearings;
The motion to be made by the Licensee will be heard on March 8, 2010 through to March 10, 2010, should it be required;
The Licensee’s Notice of Motion with supporting materials is to be delivered to the Registrar’s representative with copies to the Manager of Hearings no later than March 1, 2010. Responding materials shall be delivered no later than March 4, 2010;
Mr Isles is to provide to Mr Kulis and the Manager of Hearings, by February 26, 2010, alternate dates for the hearing of this matter.
