Allegations
1A hearing into Notice of Proposed Order (“NOPO”) dated September 8, 2009, file number 31602, to refuse the registration of 587671 Ontario Inc. (the “Applicant”), operating as A-ONE VARIETY, 80 Government Road West, Kirkland Lake, Ontario, P2N 2E4, as a supplier in the class of Lottery Retailer and Break Open Ticket Seller, on the basis that it is not entitled to registration under section 10 of the Gaming Control Act, 1992, was held on November 24, 2009 in the City of Timmins.
Preliminary Matters
2Mr. Lucien Quenneville, the sole director of the Applicant, waived the right to be represented by legal counsel on behalf of the corporate Applicant.
3Ms Chan informed the Board that Mr. Quenneville acknowledges that his gaming registration with the Alcohol and Gaming Commission of Ontario (“AGCO”) had been cancelled in 2003 and that he did not admit that it had been cancelled on AGCO application forms in 2003, 2005 and 2009, as he misunderstood the nature of the questions.
4Ms Chan further advised the Board that, in light of Mr. Quenneville’s admission and explanation in paragraph 3, the Registrar does not object to the application being granted, subject to the following conditions which the Applicant agrees to:
Mr. Quenneville shall not have any involvement in operations, conduct and management of sales and redemption of OLG products and break open tickets.
Mr. Quenneville’s name shall be removed from the OLG retailer agreement with 587671 Ontario Inc., operating as A-One Variety, within 14 days of November 24, 2009.
Mr. Quenneville confirmed that he consents to the above conditions on behalf of the corporate Applicant.
Order
5Based on the agreement of the parties, as outlined above, the Board confirms its oral ORDER that NOPO dated September 8, 2009 be set aside and the registration of 587671 Ontario Inc., operating as A-ONE VARIETY, 80 Government Road West, Kirkland Lake, Ontario, P2N 2E4, as a supplier in the class of Lottery Retailer and Break Open Ticket Seller, be approved subject to the two conditions outlined in paragraph 4 above.
