Allegations
[1]. A hearing into Notice of Proposal number 17525 dated September 9, 2009 to suspend liquor license number 802546 issued to 6664849 Canada Ltd. (the “Licensee”), operating as 2000 PLUS ONE DONUTS & DELI, 1150 Ellesmere Road, Toronto, Ontario, M1P 2X4, on the basis of alleged violations of subsections 45(1) and 45(2) of the Liquor Licence Act (the “LLA”) and section 25, subsection 34(1) and 44(1) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the LLA, convened on December 21, 2009 in the City of Toronto.
Preliminary Matters
[2]. Jianping Zhou is the shareholder, officer and director of the Licensee. He appeared on his own behalf and on behalf of the Corporation and waived the right to be represented by a licensed representative.
[3]. Elvira d’Ambrosio, representing the Registrar’s Office, advised the Board that Daniel Alakas was scheduled to appear on this matter as Registrar’s Representative but was not present due to unforeseen circumstances. She had just received the file and under the circumstances, asked for an adjournment, extending apologies to the Board and the Licensee.
[4]. Mr. Zhou objected to the adjournment, stating that he has a small business and it is hard to arrange to be present. He noted that he has been in attendance since 8:00 a.m. and was prepared to proceed today.
Decision
[5]. In these unusual circumstances, the Board is prepared to adjourn the hearing to a date that accommodates the Licensee’s schedule which will be peremptory on the Registrar.
[6]. The Board acknowledged the inconvenience to the Licensee, extending apologies but also recognizes that these are circumstances beyond the Board’s control.
Order
[7]. Therefore, the Board hereby ORDERS that the matter be adjourned, peremptory upon the Registrar, to a date to be set by the Hearings Case Management Co-ordinator.
