O R D E R
WHEREAS a hearing into Notice of Proposal number 16836 dated November 18, 2008 and Notice of Proposal number 16944 dated December 23, 2008 to suspend liquor licence number 201668 issued to 1081943 Ontario Limited, (the “Licensee”), operating as FLUID LOUNGE AND RESTAURANT, 217 Richmond Street West, Toronto, Ontario, M5V 1W2, on the basis of alleged violations of subsection 45(2) of Ontario Regulation 719/90 (the “O.Reg”), made pursuant to the Liquor Licence Act, was held on October 13, 2009 in the City of Toronto;
AND WHEREAS in its Decision dated October 20, 2009, the Board found that the Licensee violated subsection 45(2) of the O.Reg, and ordered a TWENTY-EIGHT (28) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 201668 issued to 1081943 Ontario Limited, operating as FLUID LOUNGE AND RESTAURANT, 217 Richmond Street West, Toronto, Ontario, M5V 1W2, be SUSPENDED for TWENTY-EIGHT (28) consecutive days to COMMENCE at 11:00 a.m. on January 4, 2010 and continue until 2:00 a.m. on February 1, 2010.
