O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on September 8, 2009, pursuant to Notice of Proposal (“NOP”) number 17422 dated July 27, 2009, to suspend liquor licence number 200049 issued to 1682298 Ontario Inc. (“Licensee”) operating as SPEARMINT RHINO GENTLEMEN’S CLUB, 280 Carlingview Drive, Etobicoke, Toronto, Ontario, M9W 5G1;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Jerry Levitan, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter will be heard at a hearing as yet to be scheduled;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10, ten (10) days before the hearing date.
