AMENDED ORDER
WHEREAS a hearing into Notice of Proposal number 15947 dated July 31, 2007 to suspend liquor licence number 801766 issued to Rejeanne’s Bar and Grill Ltd., (the “Licensee”), operating as REJEANNE’S BAR AND GRILL, 700 Balmoral Drive, Unit 1, Brampton, Ontario, L6T 1X2, on the basis of an alleged violation of subsection 45(1) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the Liquor Licence Act, was held on January 7, 2008 in the City of Toronto;
AND WHEREAS in its decision of March 4, 2008, the Board found that the Licensee had violated subsection 45(1) of the O.Reg;
AND WHEREAS in its decision of April 3, 2008, the Board ordered a TEN (10) day suspension of the liquor licence;
AND WHEREAS in its Order of April 18, 2008, the Board ordered the suspension period to be served from 11:00 a.m. on June 16, 2008 until 2:00 a.m. on June 26, 2008;
AND WHEREAS the Licensee appealed the Board’s Decision to the Ontario Superior Court of Justice (“Divisional Court”) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Order dated June 19, 2009;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 801766 issued to Rejeanne’s Bar and Grill Ltd., operating as REJEANNE’S BAR AND GRILL, 700 Balmoral Drive, Unit 1, Brampton, Ontario, L6T 1X2, be SUSPENDED for TEN (10) consecutive days to commence at 11:00 a.m. on September 7, 2009 and continue until 2:00 a.m. on September 17, 2009.
