21 MCMURCHY AVENUE NORTH, BRAMPTON

O R D E R
WHEREAS a hearing into a Notice of Proposal (“NOP”) number 16861 dated November 24, 2008 to suspend liquor licence number 804451 (the “Licence”) issued to 902209 Ontario Limited (the “Licensee”) operating as MAGNUM’S PUB, 21 McMurchy Avenue North, Brampton, Ontario, L6X 1X4 (the “establishment” or “premises”), on the basis of alleged violations of subsection 45(1) of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the Liquor Licence Act (“LLA”) was held on March 31 and April 24, 2009 in the City of Toronto;
AND WHEREAS in its decision of July 17, 2009 the Board found that the Licensee had breached subsection 45(1) of the O.Reg, with respect to two patrons and dismissed the allegation of a violation of subsection 45(1) of the O.Reg with respect to a third patron;
AND WHEREAS in its decision of August 27, 2009 the Board ordered a NINE (9) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates in January, 2010, or alternatively November 8 to 16, 2009 should the Board not be prepared to extend time for service of the suspension to the January dates;
AND WHEREAS the Board is not prepared to accept suspension dates outside the parameters set by the Board, that is that this suspension be completed within 90 days of the decision;
AND WHEREAS the alternate suspension dates of November 8, 2009 to November 16, 2009 are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 902209 Ontario Limited operating as MAGNUM’S PUB, 21 McMurchy Avenue North, Brampton, Ontario, L6X 1X4, licence number 804451, be SUSPENDED for NINE (9) consecutive days to COMMENCE at 11:00 a.m. on November 8, 2009, and continue until 2:00 a.m. on November 17, 2009.
