AND IN THE MATTER OF THE BOARD’S DECISION
DATED MAY 12, 2009
A M E N D I N G O R D E R
WHEREAS in its Decision dated May 12, 2009, the Board approved the application for a liquor licence made by Eric Macedo and Brad Randy Macedo operating or intending to operate as MIDPOINT BISTRO, 1180 Queen Street West, Toronto, Ontario, M6J 1J5, subject to all the statutory conditions and municipal regulations;
AND WHEREAS the Board further Ordered, on consent of all parties, that conditions be attached to the licence;
AND WHEREAS Jerry Levitan, the Applicant’s representative, advised that the conditions submitted at the hearing and agreed to by the parties was not the most current version and was missing one part of one of the conditions agreed to and requested an amendment to the conditions;
AND WHEREAS Randall Kerr, the Resident Objector, has confirmed that he is in agreement with the proposed amendment;
THEREFORE the Board hereby AMENDS the second condition of the Order to read as follows:
“2. a) The Licensee shall construct and operate the premises in such a manner that all sound waves potentially affecting adjoining residents are contained within the perimeter of the premises. Such sound waves or vibration must not be sensed either as audible sound or as vibration to such residents.
b) The Licensee shall at all times abide by the City of Toronto noise by-law, and in particular, in relation to sound emanating onto the street. Sound emanating from the establishment should not be audible on the south side of Queen Street West. The Licensee shall ensure that the exit and entrance doors will not be propped open, nor any windows kept open after 11:00 p.m. if music is being played inside.”
