Allegations
A hearing into Notice of Proposal number 17312 dated June 18, 2009 to revoke and an Order dated June 18, 2009 to immediately suspend on an interim basis liquor licence number 807401 (the “Licence”) issued to Hotel Boutique Lounge Inc. (the “Licensee”), operating as HOTEL BOUTIQUE LOUNGE, 77 Peter Street, Toronto, Ontario, M5V 2G4, (the “premises” or the “establishment”), with respect to section 6 of the Liquor Licence Act (the “LLA”) having regard to the Licensee’s financial position, the Licensee cannot reasonably be expected to be financially responsible in the conduct of the Licensee’s business and on the basis of alleged violations of section 29 and subsections 25(1) and 45(2) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the LLA, was held on June 30, 2009 in the City of Toronto.
As a preliminary matter Mr. Kulis asked for an adjournment of this matter because of the additional disclosure he received from police which Licensee’s Representative had not yet seen and which he will need to review.
Mr. Christie agreed that he will need time to review the additional disclosure. He agreed to keeping in place the suspension order dated June 18, 2009 until the next hearing date.
Mr. Christie submitted further that he is not available on the next scheduled date of July 9, 2009 because of a commitment in Court.
After reviewing the submissions of the parties, the Board ADJOURNS the matter to a date to be determined by the Hearings Department.
Furthermore, it ORDERS that the immediate suspension Order of the Registrar dated June 18, 2009 will remain in effect until the next hearing date.
