Allegations
A hearing into Notice of Proposal number 17346 dated June 24, 2009 and an Order dated June 2009, to immediately suspend a liquor licence on an interim basis issued to liquor licence number 203871 (the “Licence”), issued to Cranky Joe’s Roadhouse Too Inc., (the “Licensee”), operating as CRANKY JOE’S ROADHOUSE HANMER, 5085 Highway 69 North, Hanmer Valley Shopping Plaza, Hanmer, Ontario, P3P 1J2, on the basis of alleged violations of section 39 and subsection 45(1) of Ontario Regulation 719/90 made pursuant to the Liquor Licence Act, commenced on July 9, 2009, in the City of Sudbury.
The Registrar issued an interim suspension of the Licensee’s licence in the interest of public safety and subject to an Order by the Board of the Alcohol and Gaming Commission of Ontario (the Interim Suspension).
During the afternoon on July 9, 2009, Mr. Fournier, Licensee’s Representative brought a motion forward to lift the interim suspension. Additional days to complete the hearing will have to be held, but are unscheduled at this time.
Order
- Based on the seriousness of the allegations before the Board and the possible impact of those allegations on the public safety, the Board FINDS that it is in the public’s interest that the Interim Suspension currently in place on liquor licence number 203871, issued to Cranky Joe’s Roadhouse Too Inc., operating as CRANKY JOE’S ROADHOUSE HANMER, 5085 Highway 69 North, Hanmer Valley Shopping Plaza, Hanmer, Ontario, P3P 1J2, remains in effect until the earlier of the time when the Board renders its final decision on the matters before it or the Board orders otherwise.
