O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on January 5, 2009, pursuant to Notice of Proposal (“NOP”) number 16675 dated October 2, 2008, to suspend liquor licence number 809906 issued to Zucca Bar Inc. (“Licensee”) operating as ZUCCABAR (THE), 299 James Street North, Hamilton, Ontario, L8R 2L4;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Jaime Stephenson, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing February 17, 2009;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and “will say” statements for each witness, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
