O R D E R
WHEREAS a hearing into a Notice of Proposal number 16256 dated May 9, 2008 to suspend liquor licence number 808069 (the "Licence") issued to Albina Ingratta, Umberto Ingratta operating as LA MOLISANA CAFÉ (the "Licensee"), 209 Talbot Street West, Lot 4, Concession 2, Leamington, Ontario, N8H 1N8 on the basis of alleged violations of subsections 34(1) and 45(1) and section 45.1 of Ontario Regulation 719/90 ("O.Reg") made pursuant to the Liquor Licence Act ("LLA"), was held on October 8, 2008 in the City of Windsor;
AND WHEREAS in its decision of October 24, 2008 the Board found that the Licensee had breached subsections 34(1) and 45(1) of the O.Reg;
AND WHEREAS in its decision of January 8, 2009 the Board ordered a SEVEN (7) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to Albina Ingratta, Umberto Ingratta operating as LA MOLISANA CAFÉ, 209 Talbot Street West, Lot 4, Concessions 2, Leamington, Ontario, N8H 1N8, licence number 808069, be SUSPENDED for SEVEN (7) consecutive days to COMMENCE at 11:00 a.m. on February 2, 2009 and continue until 2:00 a.m. on February 9, 2009.
