O R D E R
WHEREAS a hearing was commenced into Notice of Proposal number 16770 dated October 29, 2008, to revoke liquor licence number 11363 issued to 2078841 Ontario Ltd. ( the “Licensee”), operating as AIRPORT MOTOR INN, 1716 London Line Road, Sarnia, Ontario, N7T 7H2 (the “establishment” or the “premises”) on the basis of alleged violations of paragraphs 6(2)(a), 6(2)(d) and 6(2)(f) of the Liquor Licence Act on March 3, 2009 in the City of Sarnia;
AND WHEREAS in its decision of March 4, 2009 the Board confirmed its oral order to adjourn the matter for a 30-day period to allow time for the parties to resolve the Retail Sales Tax matter at issue, failing which a new hearing date would be scheduled;
AND WHEREAS in his letter dated April 7, 2009, Mr. Alakas advised that on March 19, 2009, Mr. Ranjeet Chahal was appointed as Receiver by the Ontario Superior Court, Justice Cameron, further to which a temporary transfer of the licence was granted to 1418057 Ontario Inc. on March 24, 2009;
AND WHEREAS as a result, Mr. Alakas advised, NOP number 16700 was rendered moot, and the Registrar was requesting the Board allow for its withdrawal;
THEREFORE in the circumstances, the Board ACCEPTS the Registrar’s request that the Notice of Proposal number 16770 dated October 29, 2008, to revoke liquor licence number 11363 issued to 2078841 Ontario Ltd. operating as AIRPORT MOTOR INN, 1716 London Line Road, Sarnia, Ontario, N7T 7H2, be WITHDRAWN.
